GaryYoung1 Ohio Burn Laws – Wayne Lakes is classified a restricted area by EPA.

Please pay attention to the following rules & penalties:

Ohio’s Open Burning Regulations – OAC 3745-19

• Restricted Areas1

• Cooking for human consumption (barbecues, cookouts)

• Heating tar, welding, acetylene torches, highway safety flares, heating for warmth of outdoor workers & strikers, smudge pots & similar occupational needs(The above fires must not be used for waste disposal&shall be of minimum size for their intended purpose.)With prior notification to Ohio EPA or local air agency:

• Agricultural waste (from farming/agricultural operations only) – the fire must be located at a point on the property which is at least 1,000 feet from the nearest inhabited neighboring residence & the waste must be generated on the premises (waste may not be hauled in from off-site) • Ceremonial fires (organized events such as pep rallies or scout gatherings) – must be less than 5ft x 5ft; may not burn for longer than 3 hours&may not be used for waste disposal purposes

• Prevention or control of disease or pests, with written or verbal verification from appropriate agency. With written permission from Ohio EPA or local air agency:

• Fire training; Range,horticultural or wildlife management; Limited circumstances w/OEPA approval Can a Community enact local ordinances to allow open burning? Local ordinances cannot be less strict Thant state law. They can be more strict, however. What will happen to me if I’m caught illegally open burning? Ohio EPA, Local Air Agencies, and local Health Departments have legal authority to enforce the open burning laws. Violations can result in substantial penalties. If you have any questions, or would like to report a suspected open burning incident, contact your Ohio EPA district office or your local air pollution control agency. The Regional Air Pollution Control Agency (RAPCA) is designated Ohio EPA representative for Clark, Darke, Greene, Miami, Montgomery and Preble counties. **RAPCA issues open burning permits to residents of the above counties at no charge. We have a noise ordinance in our Village. A copy is attached as some people feel they do not need to pay attention to this ordinance.

Ordinance No. 02-08 -TITLE: An Ordinance Concerning Noise and Improper Use of Motor Vehicles.

WHEREAS, the Council of the Village of Wayne Lakes hereby determines that the following noise regulations be adopted and that this is necessary to preserve the public health, safety and welfare of the residents of the Village of Wayne Lakes.

Section 1: That no person shall play any radio, music players, such as a “boom box,” tape cassette, disc player or other audio system or sound device, in a motor vehicle at such volume as to disturb the quiet, comfort or repose of other persons or at a volume that is plainly audible to persons other than the occupants of said vehicle.

Section2: That no person shall disturb the peace and good order of the Village while operating a motor vehicle on public streets or parking lots by causing excessive noise by the squealing of tires or by unnecessary blowing of horns, whistles or other devices, or in any way create a nuisance through the improper use of a motor vehicle.

Section 3: That a fine of Fifty Dollars ($50.00) for each offense plus any expense by the Village to cite and collect such fine shall be imposed.

Section 4:That this ordinance shall be declared an emergency and shall be in full force and effect from and after the date of passage. Dated: September 16, 2002

Stop signs mean STOP. 25mph speed limit is throughout the village. It’s the law. You are expected to obey it. It is sad to have to expound on these laws, but violation is getting out of hand. This is a residential community. Respect the laws and your neighbors.

Still have $1000 reward for information leading to arrest & conviction of person or persons breaking into vehicles. This includes mail box vandalism. Someone knows, if you want to be part of our Village speak up so we can stop this before someone is seriously hurt!

    Ther was an open burn out here I think sunday and when I called the EPA they weren’t there. No way to report it. The Township Trustee’s or one of them should no better to open burn in Wayne Lakes. Wouldn’t you think?????
